The Court of Appeal on Monday put aside the judgment which maintained the appointment of Oyo State Governor Seyi Makinde. All Progressives Congress (APC) candidate in the political decision, Mr. Adebayo Adelabu, challenged the choice of the council, which rejected his request against the triumph of the Peoples Democratic Party (PDP) candidate.
When the court was delivering its judgment in Ibadan, the described the tribunal Judgement as a wrong judgment and the judgment was put aside. The court held that the APC and its candidate were not given a fair hearing by the tribunal, but ordered that the status quo before the tribunal’s judgment should remain. Makinde was declared the winner of the March 9 election. He was sworn-in on May 29 and was in office at the time the tribunal gave its ruling. The four-man panel also held that if not for the time constraint, it would have ordered a retrial by the tribunal – The Electoral Act allows only 180 days for the tribunal to exhaust and hear a petition and deliver judgment.
Both the PDP and APC are asserting triumph.
The APC said it will move toward the Supreme Court “for flawlessness of the milestone decision conveyed today by the Court of Appeal and by the Special Grace of God, we will get a great judgment.”
In an announcement by its Assistant Publicity Secretary, Prince Ayobami Adejumo, Oyo APC commended the Appellate Court’s Justices for their profession, which approved the cases of the offended parties, yet lamented that “the great individuals of the state would, in any case, need to sit tight for the last settling working on it before our up-and-comer could recover his command.
“The decision given on Monday was unambiguous, able and sound enough to persuade any educated personality about the validity regarding our case that Makinde’s assertion as the victor of the March 9 survey was finished by INEC in mistake. The outcomes reported were absurdly swelled and its impossible such intrigue could stand the trial of appropriate investigation as this was simply affirmed by the Appellate Court
